Warranty Disclaimer

Pavement Technologies International Corp. (“PavementGroup,” “we,” “our,” or “us”) stands behind its equipment with clear, written limited warranties. In general, Olympus products include a 1-year limited warranty from delivery, Stratos asphalt distributors include an 18-month limited warranty from delivery, and AmeriPatcher and AmeriSpreader equipment each include a 1-year limited warranty from delivery, all for defects in materials and workmanship under normal use and proper maintenance.


Many components on our machines—such as engines, burners, pumps, hydraulics, valves, and electronic controls—are built by OEM manufacturers. These items are covered directly by the OEM’s own warranty, according to their terms and duration, and any OEM claims are ultimately decided by the manufacturer or its authorized service network.


Because every customer’s expectations and operating conditions are different, we strongly encourage you to inspect equipment before you buy, and to review the full warranty details below. The following sections explain how our limited warranties work, how OEM coverage applies, what is and is not covered, and how to submit a claim.


1. PavementGroup Brand Limited Warranties

Unless otherwise stated in a written quotation or sales agreement signed by PavementGroup, the following limited warranties apply to new PavementGroup-branded equipment, for defects in materials and workmanship under normal use and proper maintenance:

Olympus Products (pugmills, cold feed bins, surge bins, etc.)

  • Coverage: Limited warranty against defects in materials and workmanship.


  • Term: 1 year from date of delivery to the buyer.


Stratos Asphalt Distributors

  • Coverage: Limited warranty against defects in materials and workmanship.


  • Term: 18 months from date of delivery to the buyer.


AmeriPatcher Pothole Patchers / Recyclers

  • Coverage: Limited warranty against defects in materials and workmanship.


  • Term: 1 year from date of delivery to the buyer.


AmeriSpreader Chip Spreaders

  • Coverage: Limited warranty against defects in materials and workmanship.


  • Term: 1 year from date of delivery to the buyer.


What PavementGroup will do under these limited warranties

At our option, and as your exclusive remedy, PavementGroup will:

  • Repair the defective component, or


  • Supply replacement parts, or


  • Authorize a third-party repair, or


  • In rare cases, replace the affected component or assembly.


Labor, travel time, and service-shop charges are handled in accordance with the specific warranty terms for your product and must be pre-approved in writing by PavementGroup.


2. OEM & Third-Party Manufacturer Warranties

Many products we sell are manufactured by other companies (engines, burners, pumps, hydraulics, electronics, etc.).

  • OEM components on PavementGroup brands (e.g., engines, burners, vibrators, pumps, valves, electronic controls) are covered only by the original manufacturer’s warranty, on the terms and for the duration set by that manufacturer.


  • Stand-alone OEM equipment and parts we resell (non-PavementGroup brands) are likewise covered only by the OEM warranty.


We do not expand, shorten, or modify those OEM warranties. Any description of OEM coverage in our quote, invoice, or website is a summary only; the controlling terms are those published by the OEM.

OEM warranty claims are generally processed through the OEM’s authorized dealer or service network. We will assist you with contact information and reasonable support, but the OEM makes the final decision on coverage and remedy.


3. Used Equipment & “As-Is” Sales

We sell a wide range of pre-owned equipment. Warranty on used units varies and is always defined in writing on your quotation and/or invoice.

  • Many used items are sold “AS IS, WHERE IS,” with no warranty of any kind from PavementGroup.


  • Some used items may include a limited parts-only warranty or other specific coverage, as expressly stated on your quote or invoice.


  • If a used unit still has remaining OEM warranty that is transferable, that coverage comes directly from the original manufacturer.


If a warranty is not expressly stated in writing on your quote or invoice, the used item is sold AS IS, with no warranty from PavementGroup.

Buyer Inspection Strongly Encouraged

Because used and consigned equipment can vary widely in age, prior use, and overall condition, and because every customer has different expectations of what is “acceptable,” PavementGroup strongly encourages you to inspect equipment before you buy it. Whenever possible, you (the buyer) should:

  • Visit our location to see the machine in person, and/or


  • Send your own mechanic or technician, and/or


  • Hire an independent third-party consultant to inspect and evaluate the equipment for you.


Seeing the equipment in person—and/or having your own representative inspect it—helps assure that you are satisfied with the condition of the machine before you commit to purchase. Any comments we make about condition, appearance, how a machine “runs,” or similar matters are based on limited observations at a specific point in time and are not guarantees or warranties of future performance. Your decision not to inspect (or not to hire a third party to inspect) does not create any additional warranty, promise, or right of return beyond what is expressly stated in your written quotation and invoice, to the fullest extent permitted by law.


4. Safety & Proper Use – Owner’s Responsibility

Our equipment is powerful, industrial machinery. The owner and operating company are solely responsible for safe use.

By purchasing and using equipment from PavementGroup, you agree that you and your organization will:

  • Read, understand, and follow the operator’s manuals and all safety instructions before operating the equipment.


  • Ensure all operators are properly familiar with the equipment and its controls.


  • Identify and mitigate site-specific hazards, and create a safe work environment for your crew.


  • Ensure your company’s safety manager (or equivalent) takes responsibility for jobsite safety, lock-out/tag-out, PPE, traffic control, and other safety practices.


  • Follow all applicable OSHA, MSHA, DOT, and other regulatory requirements.


PavementGroup may provide commissioning assistance, startup guidance, and Q&A support, but we do not control your jobsite, crew, or methods, and we do not assume responsibility for how equipment is used in the field.


5. What Is Not Covered

No warranty—whether PavementGroup’s limited warranty or an OEM warranty—covers damage or failures arising from anything other than a defect in materials or workmanship. Without limitation, warranty does not cover:

  • Normal wear and tear, including liners, hoses, filters, belts, tires, chains, nozzles, tips, etc.


  • Routine maintenance items (lubrication, adjustments, calibration, filters, fluids, etc.).


  • Damage from misuse, abuse, improper operation, or failure to follow manuals.


  • Operation outside rated capacities or specifications.


  • Improper installation, improper wiring, or unauthorized modifications.


  • Corrosion, rust, cosmetic damage, paint, decals, or minor oil/grease seepage.


  • Damage caused by contaminated fuels, improper fuel or oil, or incorrect hydraulic fluids.


  • Damage caused by failure to winterize, protect from freezing, or properly store equipment.


  • Acts of God, accidents, collision, fire, theft, vandalism, flooding, or other external events.


  • Downtime, rental costs, lost production, lost profits, or any other indirect or consequential losses.


Any repair performed without prior written authorization from PavementGroup (or the OEM, for OEM warranty claims) may void coverage for that issue.


6. Warranty Claim Process


To request warranty consideration:

  1. Stop using the affected component or system if continued use may cause additional damage or create an unsafe condition.
  2. Contact PavementGroup promptly with:


  • Machine model and serial number


  • Date of delivery


  • Detailed description of the issue


  • Photos and/or video when possible


  1. We may request:


  • Service reports from your mechanic or third-party shop


  • Diagnostic information (error codes, pressures, voltages, etc.)


  • Maintenance records, if relevant


For OEM component claims, we will assist in directing you to an authorized service provider when appropriate. All coverage determinations will be made by PavementGroup for PavementGroup’s limited warranties, and by the OEM for OEM warranties.


7. Warranty Disclaimer & Limitation of Liability

Except for the express limited warranties stated above and in your written sales documents:

  • PavementGroup disclaims all other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.


  • PavementGroup does not assume or authorize any other person or entity to assume any liability or obligations on its behalf.


To the fullest extent permitted by law, PavementGroup shall not be liable for:

  • Loss of profits, loss of business, loss of goodwill, or loss of data


  • Downtime, rental costs, substitute equipment, or lost production


  • Incidental, indirect, special, exemplary, or consequential damages of any kind, arising out of or related to the sale, use, or inability to use any product


In all cases, the maximum liability of PavementGroup, whether in contract, tort, or otherwise, is limited to the amount you paid for the specific product or component giving rise to the claim.

Equipment will not be released to buyer until full payment is received and funds are confirmed.


8. Website Information & Errors

We work hard to keep www.pavementgroup.com accurate and up to date, but:

  • PavementGroup makes no warranty or guarantee that information on this website is error-free, complete, or current.


  • PavementGroup reserves the right to correct errors, update content, change pricing, specifications, and warranties, and revise these terms at any time without notice.


In the event of an error in pricing, description, or other critical information:

  • PavementGroup reserves the right to refuse or cancel any order, even if your order has been submitted or payment has been processed.


  • If your order is canceled after payment, we will issue a refund in the original form of payment when possible; if that is not possible, store credit may be issued as outlined in our terms and conditions.
